The objective is not to replace the State Police

NATIONAL INDEPENDENT INVESTIGATION PROTOCOL FOR DEATHS FOLLOWING SEXUAL ASSAULT

Creative Idea / Suggestion

Establish a National Independent Investigation Protocol under which every death allegedly resulting from sexual assault automatically receives independent monitoring and review, with escalation to the CBI, independent SIT or court-monitored investigation when predefined risk conditions are present.

Present Condition

Sexual-assault cases resulting in death are exceptionally sensitive. Although State Police conduct the majority of criminal investigations, concerns can sometimes arise regarding:

• delay in investigation;
• evidence preservation;
• forensic procedures;
• CCTV/digital evidence;
• police involvement or conflict of interest;
• external influence;
• alleged cover-up; and
• lack of confidence among the victim's family.

The present system should therefore be strengthened with an independent safeguard for this category of cases.

Proposed System

Death following alleged sexual assault → Automatic independent monitoring → Evidence-preservation review → Senior independent review → Risk assessment → CBI/SIT/court-monitored investigation where required

The system should include:

0–24 hours: FIR, medical/legal procedures, crime-scene protection and evidence preservation.

Within 48 hours: Independent senior-level review.

Within a prescribed period: Assessment against objective red-flag criteria.

Escalation: CBI/SIT/court-monitored investigation where serious concerns are identified.

Automatic Red-Flag Conditions

• Alleged police involvement
• Custodial sexual assault/death
• Suspected evidence tampering
• Serious unexplained delay
• Influential accused
• Conflict of interest
• Contradictory forensic evidence
• Credible allegation of cover-up
• Serious investigative failures
• Loss of confidence in the impartiality of the investigation

Positive Change

Justice: More independent and credible investigation.

Evidence: Faster preservation of forensic and digital evidence.

Accountability: Greater scrutiny of investigative failures.

Public confidence: Victims' families can have greater confidence that the case is independently monitored.

Governance: A standardised national mechanism rather than ad-hoc intervention only after controversy arises.

The Ministry of Home Affairs, in consultation with State Governments, CBI, State Police, forensic institutions, prosecution authorities and other relevant stakeholders, could develop a national SOP/protocol.

A central monitoring framework could record:

Death → FIR → Medical examination → Post-mortem → Forensic evidence → Digital evidence → Independent review → Escalation decision → Investigation progress → Final report/charge-sheet

The mechanism should use objective criteria, not media pressure alone, and must remain consistent with India's constitutional and legal framework.

Every death following sexual assault deserves an investigation that is not only conducted, but demonstrably independent, transparent, scientifically supported and capable of public scrutiny.
