Access-to-Justice Proposal

1.
CREATIVE IDEA
Provide an independent Legal Assistance Officer/Lawyer
at every police station, preferably through the existing State/District
Legal Services Authority (SLSA/DLSA) structure.
The officer would provide simple legal guidance to citizens
at the earliest stage of a dispute.
Core principle:
“KNOW THE LAW – KNOW YOUR RIGHTS –
KNOW YOUR RESPONSIBILITIES – TAKE THE RIGHT LEGAL ACTION.”
NALSA's existing legal-services framework already covers
legal aid, legal advice, legal awareness and preventive legal-service
programmes, providing a foundation that could be explored for such a pilot.

PRESENT CONDITION
Many ordinary citizens may not know:
- What law applies to their problem.
- Whether the matter is civil or criminal.
- What their rights and responsibilities are.
- What procedure should be followed.
- What documents/evidence may be relevant.
- Whether they need legal representation.
- What lawful remedy is available.
As a result, misunderstandings and
disputes may sometimes escalate before appropriate legal guidance is obtained.

PROPOSED POSITIVE CHANGE
Create a clearly identified:
“LEGAL
ASSISTANCE & PUBLIC GUIDANCE DESK”
at every police station.
The lawyer should be independent
of the police hierarchy, with appropriate linkage to the Legal Services
Authority.
Three
separate responsibilities:

FUNCTIONS
The Legal Assistance Officer could:
1.
Explain applicable laws in simple
language.
2.
Explain citizens' rights and
responsibilities.
3.
Help distinguish
civil/criminal/other legal issues.
4.
Explain lawful procedures and
available remedies.
5.
Guide victims and witnesses.
6.
Explain safeguards applicable to
accused persons.
7.
Connect eligible persons with free legal
aid.
8.
Explain relevant documents/evidence.
9.
Provide early legal guidance to
prevent escalation.
10.
Conduct public legal-awareness
programmes.
11.
Warn citizens when a proposed action
may itself violate the law.
12.
Refer matters to the appropriate
authority or advocate.
5.
“LAW BEFORE CONFLICT”
The desk should promote five simple
questions:
What is the law?
What are my rights?
What are my responsibilities?
What lawful action can I take?
What action could put me on the wrong side of the law?
This makes legal awareness a preventive
public service, not merely a service obtained after a dispute becomes
serious.
6.
IMPORTANT SAFEGUARDS
The Legal Assistance Officer should NOT:
- interfere with police investigation;
- decide guilt or innocence;
- suppress an FIR;
- act as an investigating officer;
- represent both sides of the same dispute;
- pressure either party into settlement;
- replace an individual's independent advocate.
Independence and confidentiality
should be built into the operating model.

IMPLEMENTATION – PILOT FIRST

Select representative districts in
different States/UTs.

Use the existing SLSA/DLSA
infrastructure and empanel/appoint suitable lawyers.

Create a small dedicated
legal-assistance space at the police station.

Provide standard operating procedures, referral mechanisms
and public-awareness material.

Monitor citizen feedback, legal-aid referrals, categories of
disputes, service usage and safeguards.
